These Terms of Service (“Terms”) govern your access to and use of the VIBEKISS mobile application, website, and related services (collectively referred to as the “Platform”).

By accessing or using VIBEKISS, you agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue use of the Platform immediately.

These Terms operate together with the VIBEKISS Privacy Policy and VIBEKISS Community Guidelines, which together form the complete agreement governing your use of the Platform.

1. Eligibility

VIBEKISS is intended strictly for adults.

Users must be at least 18 years old, or the age of legal majority in their jurisdiction (whichever is higher), to create an account or use the Platform.

By creating an account, you confirm that you meet this requirement.

VIBEKISS reserves the right to suspend or terminate accounts suspected of belonging to individuals under the age of 18.

Where required by law, violations involving minors may be reported to the appropriate authorities.

Pricing may vary based on factors including region, platform provider, promotional offers, testing of pricing tiers, or market conditions.

Any pricing changes will apply to future billing cycles or new purchases.

Where required by applicable law or platform policies (including Apple App Store or Google Play policies), users will be notified before such pricing changes take effect.

Continued use of the Platform after the effective date of the pricing change constitutes acceptance of the updated pricing.

8. Subscription Renewal and Cancellation

Subscriptions may renew automatically unless cancelled before the end of the billing period.

Users may manage subscriptions through their app store account settings.

Cancellation takes effect at the end of the current billing cycle.

Except where required by law, purchases made through the Platform are generally non-refundable.

25. No Background Checks

VIBEKISS does not conduct criminal background checks.

26. Offline Interaction Disclaimer

VIBEKISS is not responsible for offline meetings arranged through the Platform.

27. Platform Monitoring Disclaimer

VIBEKISS may monitor activity but is not obligated to monitor all activity.

28. Service Modification

VIBEKISS may modify or discontinue services at any time.

29. Data Loss Disclaimer

VIBEKISS does not guarantee preservation of user data.

30. Platform Profiles and System Activity

Users acknowledge that VIBEKISS may create, maintain, or operate profiles for purposes including:

Users also acknowledge that the Platform may contain inactive, incomplete, or dormant accounts, and that user activity levels may vary.

VIBEKISS makes no guarantees regarding the authenticity, activity level, or availability of other user profiles.

Users are encouraged to report suspicious or unsafe behavior.

32. Algorithm and Visibility Disclaimer

Profile visibility may be determined by automated systems.

No guarantee is made regarding match frequency or engagement.

33. Force Majeure

VIBEKISS is not liable for events beyond its reasonable control.

If any clause is invalid, the remaining provisions remain in effect.

35. Assignment

VIBEKISS may assign these Terms without restriction.

36. Entire Agreement

These Terms, Privacy Policy, and Community Guidelines form the entire agreement.

Failure to enforce a provision does not waive that provision.

Liability and indemnification clauses survive termination.

39. Electronic Communications

Users consent to receive electronic communications.

Users agree to attempt to resolve disputes through good-faith negotiations before initiating legal proceedings.

To the maximum extent permitted by law, the protections and limitations contained in these Terms apply not only to VIBEKISS but also to its owners, directors, employees, contractors, partners, and service providers, who are considered third-party beneficiaries of these Terms.

51. Cybersecurity and Data Breach Disclaimer

While VIBEKISS implements reasonable security measures to protect user data, no digital platform can guarantee absolute security.

VIBEKISS does not guarantee the accuracy, reliability, or fairness of automated systems or algorithmic outcomes.

54. Third-Party Links, Advertising, and External Content

The Platform may contain links, advertisements, or references to third-party websites, services, or products.

VIBEKISS does not control, endorse, or verify the accuracy, safety, or legality of third-party content.

Users access external websites and services at their own risk.

To the maximum extent permitted by law, VIBEKISS shall not be responsible for damages resulting from interactions with third-party websites, services, advertisements, or products.

55. Jurisdictional Exceptions

Certain jurisdictions may not allow the exclusion or limitation of certain rights or liabilities.

Where applicable law provides mandatory consumer protections that conflict with these Terms, those protections shall apply only to the extent required by law.

All remaining provisions of these Terms shall remain valid and enforceable.

56. Deepfake and Synthetic Media Policy

Users are strictly prohibited from uploading, sharing, or creating content that uses AI, deepfake technology, or synthetic media to represent a real person without their consent.

VIBEKISS reserves the right to use detection technology to identify and remove "digital forgeries."

Violations of this policy may result in a permanent ban and reporting to legal authorities under applicable "Non-Consensual Intimate Imagery" laws.

The platform will also cooperate with law enforcement in prosecuting digital forgery, including non-consensual intimate imagery.

57. Proactive Safety and Cyberflashing

In compliance with modern online safety regulations, VIBEKISS may implement proactive technology to detect and blur unsolicited sexual imagery ("cyberflashing") before it is viewed by the recipient.

You acknowledge that this monitoring is conducted for user safety and does not constitute a waiver of our "No Monitoring Obligation" in Section 26.

Sending unsolicited sexual images is a violation of our Terms and may lead to immediate account termination without warning.

58. AI Training and User Likeness

You agree that VIBEKISS may use metadata from your interactions to improve our algorithms.

However, VIBEKISS will not use your personal profile photos to train third-party generative AI models without your explicit opt-in consent.

You interact with other users at your own risk regarding the potential for "likeness theft" by third parties.

Users are encouraged to report any unauthorized use of their likeness via the provided reporting tools.

59. Age Assurance and Verification Technology

To comply with global online safety standards and to prevent access by minors, VIBEKISS may utilize third-party age estimation or identity verification technologies.

These may include, but are not limited to, facial age estimation tools, identity document verification, or other age assurance methods.

By using the Platform, you consent to the processing of information necessary to perform such checks, which may include biometric indicators (such as facial geometry derived from a selfie) solely for the purpose of age estimation and identity verification.

Failure or refusal to complete a requested age verification process may result in temporary or permanent suspension of your account.

VIBEKISS reserves the right to deny access to the Platform where age eligibility cannot be reasonably verified.

60. Geolocation and Safety Disclaimer

The Platform may display approximate distance or location information between users to facilitate social discovery and matching.

You acknowledge that such information is intentionally imprecise and should not be relied upon for determining a user's exact location.

You agree not to use the Platform to track, stalk, harass, or monitor the movements of any individual.

Any attempt to reverse-engineer or infer a user's precise location through the Platform constitutes a violation of these Terms.

VIBEKISS is not responsible or liable for any harm, harassment, stalking, or other offline interactions that result from information voluntarily shared by users, including but not limited to personal addresses, social media handles, phone numbers, or meeting arrangements.

61. Disclosure to Law Enforcement and Safety Authorities

VIBEKISS maintains a zero-tolerance policy toward activities that threaten user safety or violate applicable law, including but not limited to:

Where VIBEKISS reasonably believes that a Priority Offense or imminent threat of harm has occurred, the Platform may preserve and disclose relevant user data—including account information, messages, uploaded media, and IP address records—to appropriate law enforcement or regulatory authorities.

Such disclosure may occur without prior notice to the affected user where permitted or required by applicable law, and is undertaken for the purpose of protecting user safety and complying with legal obligations.

62. Platform Design and Mental Well-being

VIBEKISS is intended to operate as a social discovery and communication platform.

Certain platform features—including notifications, algorithmically generated recommendations, and continuous content feeds—are standard functionalities used to facilitate user interaction.

You acknowledge that your use of the Platform is voluntary and that you are solely responsible for managing your time, engagement, and personal well-being while using the Platform.

To the fullest extent permitted by law, VIBEKISS shall not be liable for claims related to excessive use of the Platform, including but not limited to allegations of compulsive use, digital dependency, sleep disruption, emotional distress, or similar claims associated with prolonged use of online services.

63. Data Erasure and the “Right to Be Forgotten”

You may request the deletion of your account at any time through the settings within the Platform.

Upon confirmed deletion of your account, VIBEKISS will initiate the removal of your personal data from active production systems in accordance with our Privacy Policy and applicable data protection laws.

You acknowledge that certain information may be retained where legally required or reasonably necessary for the following purposes:

64. Verification Disclaimer

VIBEKISS may offer optional verification features, including but not limited to identity verification or photo verification, which may result in a user receiving a “Verified” badge.

You acknowledge that such verification only confirms that the user completed a specific verification process at a particular moment in time.

Verification does not constitute:
